Terms of use
These terms are between you and Gradient UX Limited ("we" or "us"), the company registered in England and Wales (company number 13941886) that makes Gainsmith. Our registered office is 20 Northcotts, Hatfield, England, AL9 5ES. They apply alongside Apple's Licensed Application End User License Agreement, which covers your licence to use the app. If the two differ, Apple's agreement applies to the licence, and these terms add the details specific to Gainsmith.
Using Gainsmith
- You can use Gainsmith on any Apple device you own or control, as Apple's agreement allows.
- Please don't copy, resell or reverse engineer the app, or use it to break the law.
- Gainsmith may change over time. Features can be added, improved or, occasionally, removed. Anything you've paid for stays available for as long as you're entitled to it.
Health and safety
Strength training carries some risk of injury. Gainsmith gives general guidance, not medical advice:
- Workout suggestions, weight and rep targets, warm-ups and readiness are estimates worked out from what you log. They can be wrong, and they don't know about injuries, illness or anything you haven't told the app.
- Talk to a doctor before starting a new training programme if you have a health condition, are pregnant, or are coming back from injury.
- Warm up, use good technique and safe equipment, use a spotter or safety bars for heavy lifts, and stop if you feel pain, dizziness or shortness of breath.
- You decide what you lift. Choose weights you can handle safely, whatever the app suggests.
Gainsmith Pro
- Logging, history, routines, your own exercises, import, export, Apple Health and iCloud backup are free. Gainsmith Pro adds today's suggested workout, the next target for every set, warm-up ramps, plateau help and the readiness map.
- Pro is sold through the App Store as a monthly or yearly subscription, or a one-time lifetime purchase. The price is shown in the app before you buy, in your currency.
- Where a free trial is offered, it's for new subscribers only. If you don't cancel at least 24 hours before it ends, the subscription starts and you're charged.
- Subscriptions renew automatically at the same length unless you cancel at least 24 hours before the end of the period. Your Apple ID is charged within the 24 hours before renewal.
- Manage or cancel in the Settings app, under your name, Subscriptions, or in Gainsmith under Profile, Gainsmith Pro, Manage subscription. Cancelling stops the next renewal; Pro stays on until the end of the period you've paid for.
- If a price changes, Apple tells you before it applies, and you can cancel.
- Payments and refunds are handled by Apple. Ask for a refund at reportaproblem.apple.com. Your rights under consumer law aren't affected.
Your data
Your training belongs to you. Gainsmith stores it on your device and in your own iCloud, as the privacy policy explains, and you can export it at any time. Because we don't hold a copy, we can't restore it for you, so keep iCloud backup on if you'd like it to survive a lost or broken iPhone.
Our responsibility to you
- We work hard to keep Gainsmith accurate and reliable, but it's provided as it is, and we can't promise it will always be free of errors or available without interruption.
- We aren't responsible for injury, loss or damage caused by how you train, or by relying on the app's estimates instead of your own judgement, except where the law says we must be.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law. If you're a consumer, your statutory rights are not affected.
Law and changes
These terms are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If we change these terms, we'll update this page and the date at the top, and mention important changes in the app's release notes.
